On December 29, 2014, the General Office of the State Council issued the "National Emergency Response Plan for Environmental Emergencies" with Guoban Letter [2014] No. 119. The "Plan" is divided into 7 parts: general provisions, organizational command system, monitoring and early warning and information reporting, emergency response, post-work, emergency support, and supplementary provisions. The Ministry of Environmental Protection is responsible for interpretation and will be implemented from the date of issuance. On May 24, 2005, the National Emergency Response Plan for Environmental Emergencies, which was approved by the State Council and issued by the General Office of the State Council, was repealed.

The Ministry of Environmental Protection is responsible for the guidance and coordination of the response to major and extraordinarily serious environmental emergencies and the daily supervision and management of environmental emergencies. According to the development trend and impact of environmental emergencies, the Ministry of Environmental Protection or the provincial people's government may report to the State Council for approval, or according to the instructions of the leaders of the State Council, set up a working group of the State Council to be responsible for guiding, coordinating and urging relevant regions and departments to carry out environmental emergencies. Incident response work. When necessary, the National Environmental Emergency Command Headquarters shall be established, and the leading comrades of the State Council shall serve as the commander-in-chief to lead, organize and direct the emergency response work in a unified manner; the General Office of the State Council shall perform the responsibility of information collection and comprehensive coordination, and play the role of the operation hub. The local people's government at or above the county level shall be responsible for the response to environmental emergencies within its administrative region, and shall specify the corresponding organization and command structure. The response to environmental emergencies across administrative regions shall be jointly responsible by the people's governments of all relevant administrative regions, or shall be jointly responsible by the local people's governments at the next higher level in the relevant administrative regions. For environmental emergencies across provincial administrative regions that require coordinated handling at the national level, the relevant provincial people's government shall submit a request to the State Council, or the relevant provincial environmental protection authority shall submit a request to the Ministry of Environmental Protection.
